Rubbish Removal Uxbridge Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Uxbridge provides rubbish removal, waste collection and related services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the individual, business, organisation or other party booking or receiving services from Rubbish Removal Uxbridge.

Company, we, us or our means Rubbish Removal Uxbridge, the provider of rubbish removal and waste collection services.

Services means the rubbish removal, waste clearance, collection, loading, transportation and disposal services, and any related services, provided by the Company.

Booking means a request by the Customer for Services, whether made by telephone, email, online or in writing, which is accepted by the Company.

Waste means items, materials or substances presented by the Customer for removal, including household waste, garden waste, bulky items, commercial waste and other non-hazardous materials.

2. Scope of Services

The Company provides rubbish removal and waste collection services within its operational area. The precise services to be provided will be as described in the quotation or as otherwise agreed with the Customer at the time of booking.

Our services typically include the loading of waste from the Customer’s premises or an agreed collection point, transportation of that waste, and its lawful disposal at a licensed facility or via an authorised recycler.

The Company reserves the right to refuse to remove any items which, in its reasonable opinion, are unsafe to handle, illegal to transport, or fall outside the scope of services agreed at the time of booking.

3. Booking Process

Customers may request a booking by telephone, email or online form. The Customer will be asked to provide details of the waste to be collected, the location, access conditions, and any other relevant information.

Any quotation or price estimate provided prior to arrival is based on the information supplied by the Customer. The final price may be adjusted on site if the volume, weight, type of waste or access conditions differ materially from those described during the booking process.

A booking is only confirmed when the Company has accepted the request and provided a confirmation by telephone, email or other agreed communication method.

The Customer is responsible for ensuring that all information given to the Company is accurate and complete. The Company will not be liable for delays, additional costs or failure to complete the Services arising from inaccurate or incomplete information.

4. Access and Customer Responsibilities

The Customer must ensure that our operatives have safe, reasonable and timely access to the waste and to the collection point at the agreed time. This includes providing any necessary access codes, parking permissions and instructions for entry.

The Customer must ensure that the waste to be collected is clearly identified and is located in a position that allows safe manual handling by our operatives. Sharp, dangerous or heavy items must be disclosed in advance.

If access is restricted or the collection cannot proceed at the agreed time for reasons outside the Company’s control, the Company may charge a call-out fee or waiting time, or may treat the visit as a cancellation and apply the relevant charges under clause 8.

The Customer must not present hazardous, explosive, highly flammable, chemical, medical or other controlled waste without prior written agreement from the Company. The Customer is solely responsible for any consequences arising from misdescription of hazardous or prohibited waste.

5. Quotations and Pricing

Quotations are generally based on the estimated volume, weight and type of waste and the ease of access to the collection point. Unless otherwise stated, quotations are exclusive of any applicable taxes or third-party charges.

All quotations are given in good faith but do not constitute a binding offer until confirmed by the Company. Quotations are normally valid for a limited period, which will be stated at the time of issue or, if not stated, for 30 days.

If, upon arrival, the amount or nature of waste differs from that described at the time of booking, or if access conditions are more difficult than disclosed, the Company may adjust the price to reflect the actual work required. The Customer will be informed of any revised price before work is carried out and may choose whether to proceed.

6. Payments and Invoicing

Unless otherwise agreed in writing, payment is due in full on completion of the Services. The Company accepts payment by cash, debit card, credit card and other methods as communicated to the Customer from time to time.

For business or account Customers, payment terms may be agreed separately. Where invoicing is agreed, invoices are payable within the period specified on the invoice. If no period is specified, payment is due within 14 days of the invoice date.

The Company reserves the right to charge interest on late payments at the statutory rate applicable in England and Wales. The Customer will be responsible for all reasonable costs incurred by the Company in recovering overdue amounts, including legal fees and debt collection charges.

The Company may at any time require full or part payment in advance, particularly for large collections, commercial contracts or specialist services.

7. Cancellations and Amendments

The Customer may cancel or amend a booking by giving reasonable notice to the Company. Notice should be given by telephone or email using the contact details provided at the time of booking.

Where cancellation is made at least 24 hours before the scheduled collection time, no cancellation fee will normally be charged. The Company reserves the right to apply a reasonable cancellation charge where significant preparatory work has already been carried out.

Where cancellation is made less than 24 hours before the scheduled collection time, or where our operatives attend site and are unable to carry out the work due to reasons beyond the Company’s control, the Company may charge a cancellation or call-out fee to cover costs and lost time.

If the Customer wishes to amend the time, date, location or scope of the Services, the Company will use reasonable efforts to accommodate the request, but cannot guarantee availability. Changes may result in a revised quotation or altered charges.

8. Waste Types and Regulations

The Company carries out rubbish removal and waste collection in accordance with applicable UK laws, regulations and codes of practice, including duty of care obligations relating to waste handling and disposal.

The Customer must not present for collection any waste that is unlawful to transport or dispose of, including but not limited to certain hazardous, chemical or regulated materials, unless the Company has expressly agreed in writing to handle such waste and appropriate arrangements and charges have been agreed.

Acceptable waste typically includes general household waste, furniture, appliances, garden waste, non-hazardous commercial waste and similar items. However, some items such as fridges, freezers, tyres, electrical equipment or mattresses may attract supplementary charges due to disposal costs.

If prohibited or hazardous waste is discovered during loading or after removal, the Company may suspend or terminate the Services, return the waste where lawful and practicable, or arrange specialist disposal at the Customer’s cost. The Customer will indemnify the Company for any liability, fines, penalties, costs or losses arising from misdescription or unlawful presentation of waste.

9. Performance of the Services

The Company will use reasonable care and skill in providing the Services and will make reasonable efforts to carry out collections at the agreed time. Any timescales provided for arrival or completion are estimates only and are not guaranteed.

External factors such as traffic, weather conditions, road restrictions and operational issues may affect arrival or completion times. The Company will not be liable for any loss, damage or inconvenience arising from delays outside its reasonable control.

Where a collection cannot be carried out as booked due to unforeseen circumstances, the Company will contact the Customer as soon as reasonably possible to arrange an alternative time or date.

10. Damage and Liability

The Company will take reasonable care when carrying out the Services. However, minor scuffs, marks or superficial damage may occur in the normal course of moving bulky or heavy items, particularly in confined spaces. The Customer is responsible for protecting floors, walls and fixtures where deemed necessary.

The Company’s total liability for any loss or damage arising from the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by the Customer for the specific booking in question, except where such limitation is not permitted by law.

The Company will not be liable for loss of profits, loss of business, loss of opportunity, or any indirect or consequential loss. Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud or any other liability which cannot be excluded under applicable law.

11. Customer Property and Missed Items

The Customer is responsible for ensuring that any items intended to be retained are kept separate from the waste to be removed. The Company cannot guarantee the retrieval of items once they have been loaded onto our vehicles or mixed with other waste.

The Company does not accept liability for personal belongings, documents, valuables or other items mistakenly included in waste unless the Customer can show that the Company was expressly informed of their presence and agreed to protect or retrieve them.

12. Insurance

The Company maintains appropriate insurance cover for its operations, including public liability insurance, as required by law and good industry practice. Details of insurance cover can be provided on request.

13. Complaints and Disputes

If the Customer is dissatisfied with any aspect of the Services, the Customer should contact the Company as soon as possible, setting out the nature of the issue, the date of the booking and any relevant details. The Company will investigate and seek to resolve complaints promptly and fairly.

Where a dispute cannot be resolved directly between the parties, either party may pursue any legal rights and remedies available under the laws of England and Wales.

14. Data Protection and Privacy

The Company collects and processes personal data such as names, contact details, addresses and payment information for the purposes of managing bookings, providing Services, processing payments and complying with legal obligations.

Personal data is handled in accordance with applicable data protection laws in the United Kingdom. The Company takes reasonable steps to safeguard personal information and will not share it with third parties except where necessary to perform the Services, process payments or comply with legal or regulatory requirements.

15. Variations to Terms

The Company reserves the right to update or amend these Terms and Conditions from time to time. Any changes will take effect when published or communicated to the Customer and will apply to new bookings made after that date.

The version of the Terms and Conditions in force at the time of booking will apply to that booking, unless the parties agree otherwise in writing.

16. Force Majeure

The Company will not be liable for any delay or failure to perform its obligations where such delay or failure is caused by events or circumstances beyond its reasonable control, including but not limited to extreme weather, accidents, road closures, industrial disputes, power failures, acts of government or other force majeure events.

In such circumstances, the Company may suspend the Services for the duration of the event or, where necessary, cancel the booking and refund any amounts paid for Services not performed.

17. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of rubbish removal and waste collection services by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

18. Severability

If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms and Conditions, together with any written quotation or written confirmation of booking provided by the Company, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or understandings.

No variation of these Terms and Conditions will be binding unless agreed in writing by an authorised representative of the Company.
